Decision by Appeals Panel Will Keep South Bend Abortion-Free

INDIANAPOLIS – Today a three-member appeals panel met in Indianapolis to determine the future of the proposed abortion facility in South Bend, Ind. After a nearly two-hour hearing, the panel overturned an administrative judge’s October recommendation that Whole Woman’s Health Alliance (WWHA) be granted an abortion license. Today’s appeals panel’s 2-1 decision will keep South Bend abortion-free, though WWHA has pledged to appeal and continue its legal battle.

The appeals panel consisted of an administrative law judge and two members of the Indiana State Department of Health’s executive board.

WWHA first applied for an abortion facility license in 2017. The State of Indiana denied WWHA’s application for an abortion license in January. The denial letter stated: “Based upon the Department’s review, the Commissioner finds WWHA failed to meet the requirement that the Applicant is of reputable and responsible character and the supporting documentation provided inaccurate statements and information.”

“The appeals panel delivered great news for the health and safety of women and children in South Bend,” said Mike Fichter, President and CEO of Indiana Right to Life. “The effort to keep South Bend abortion-free has been ongoing for more than a year, and we hope this is the final resolution. But if the abortion operators continue their legal battle, we pray the state will continue their own diligent work so that the abortion facility never opens in South Bend.”
